We do not sell or share personal information of California residents within the meaning of “sold” or “shared” under the CCPA/CPRA, and we have not done so in the past 12 months. Further, we do not have actual knowledge that we sell or share personal information of residents under 16 years of age. We only use sensitive personal information for the specific business purposes set forth above and permissible under the CCPA, and do not use sensitive personal information to infer characteristics about you.
Your California Privacy Rights
If you are a California resident, you have the additional rights as described below.
Right to Know About Personal Information Collected, Disclosed, or Sold.
In addition to the rights described in other sections of this Privacy Policy, California law permits California residents to request and obtain from us twice a year, free of charge, information about our collection and use of your personal information. Novogene does not share your personally identifiable information with third parties for their own marketing purposes without your consent. Once we receive and confirm your verifiable consumer request (instructions and description below), we will disclose to you:
· The categories of personal information we collected about you;
· The categories of sources for the personal information we collected about you;
· Our business or commercial purpose for collecting or disclosing that personal information;
· The categories of third parties with whom we disclose that personal information;
· The specific pieces of personal information we collected about you;
· If we disclosed your personal information for a business purpose, a list of disclosures identifying the categories of personal information that each category of recipient purchased or obtained; If we shared your personal information for cross-context behavioral advertising, a list of categories of personal information shared with each category of third party.
Right to Access & Data Portability
You have the right to obtain a portable copy of the personal information you have provided to us, in a structured, commonly used, machine-readable format.
Right to Delete
You have the right to request deletion of your personal information, subject to certain exceptions (such as when the information is necessary to complete a transaction, detect security incidents, comply with a legal obligation, or make other internal and lawful uses of the information).
Right to Correct
You have the right to request correction of inaccurate personal information we maintain about you. If we correct your information based on your request, we will, upon your request, provide you with the name of the source from which the inaccurate information originated, or we will notify that source ourselves. We will also take reasonable steps to ensure the corrected information remains accurate and is not overwritten by subsequent updates from the same source (e.g., a data broker). In the specific case of health information, if we deny your correction request, you have the right to submit a written statement of dispute (not to exceed 250 words) regarding the accuracy of the information. Upon your request, we will provide this statement to any party that previously received the disputed information.
Right to Limit Use and Disclosure of Sensitive Personal Information
You have the right to direct us to limit the use or disclosure of your sensitive personal information to those uses which are necessary to perform the services or provide the goods reasonably expected by an average consumer, or as otherwise authorized by law.
Right to Opt-Out of Sale or Sharing
California residents have the right to opt out of the “sale” or “sharing” of their personal information for cross-context behavioral advertising. We do not currently sell or share your personal information in this manner. Should our practices change in the future, we will update this notice and provide you with an effective opt-out mechanism. Please note that we may continue to share your personal information with our service providers for such essential purposes described above and other such circumstances.
Non-Discrimination
We support your ability to exercise your privacy rights. We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
· Deny you goods or services.
· Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
· Provide you a different level or quality of goods or services.
· Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Response Timing and Format.
We endeavor to substantively respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosure we provide will only cover the 12- month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We may ask you to provide information to verify your identity before processing your request. You may also designate an authorized agent to submit a request on your behalf, subject to verification.
California Shine the Light Law.
